Contact Lens Consumer Act: The Federal Trade Commission Ruling

Evaluating and managing contact lenses for successful wear is still a very dear passion to our doctors and staff. The definition of expected success is determined after a lengthy conversation with one of our doctors before the contact lens evaluation ever begins. Success is different for every patient. Every patient has a unique set of visual demands combined with individual eye dimensions and tear chemistry. We take all these elements into consideration when discussing options to maximize expected success. We pride ourselves are setting realistic expectations to maximize outcomes.

One of the most commonly asked questions when scheduling an appointment is “What is the contact lens evaluation and consultation fee?”. This is a fee that covers the professional time of the doctor and the office staff that is above and beyond the time it takes for a basic ophthalmologic exam. A basic exam includes the refraction for glasses and an eye health evaluation. According to Current Procedural Terminology (CPT) codes 92310-92326 for evaluation of contact lenses states: “The prescription of contact lens includes specification of optical and physical characteristics (such as power, size, curvature, flexibility, gas-permeability). It is NOT a part of the general ophthalmological services.”

In addition, according to FTC ruling in the Contact Len Consumer Act, F16 C.F.R. Part 315, contact lens prescriptions are mandated to expire annually, unless special circumstances arise where the doctor feels it medical necessary create an earlier expiration date. Therefore, whether a patient is renewing a prescription or a first time wearer, they must have an annual contact lens evaluation and consultation in addition to the basic refraction and ophthalmologic exam.
